It is imperative that this bug is fixed. Even though all the beta testers now are testing the new theme (that hides the bookmark bar and puts the tabs on top), a lot of users, when being asked to upgrade press yes, will probably want the tabs on the bottom, and the bookmark bar back, like they were used to. I think this should block the final version. (It shouldn't be so hard to implement. There's even room for it. Just a simple CSS patch, and you're done.)
Looking at the currently nightly, it appears that the black line on the other sides of the bookmark toolbar are also not there, so it doesn't look as funny, but I think all 3 should be there.
Is it really supposed to be there, though? With Aero, the topmost toolbar (if the menu bar is off) has no background, and there is no black line demarcating the topmost bar from the next bar (which does have background). In other words, with tabs on top, the navbar has no black line on top, and thus with tabs on bottom, the bookmarks toolbar has no black line on top.
According to the mock-up, the bookmark toolbar and tab strip ends and the top of the toolbar are supposed to have a border. But this is already reported as part of bug. See https://bugzilla.mozilla.org/show_bug.cgi?id=588764#c49
