The 'see all results (19)' link and the 'Clear results' button should not be in the scroll pane, but in the real footer: #commandBarBottom.

I see the issue, but my feeling here is that causes more issues than it solves to move the link and button to the footer. The fact that the text of the link changes (as it should) depending on the results of the search, and that the "Clear Results" button is present only during a search, means that we'd have changing and disappearing/appearing elements in the "solid" part of the window. Users are used to content in clearly-demarked content areas changing, but not controls in the solid "frame" part of the interface. On top of this, the two user-actions "clear results" and "see the full set" are both of most use after the user has scrolled through what's available on in the list. Clearing of the results is also possible from the button in the search field.

I agree that it is sort of part of the 'content' (at least the 'number of results'). However, the 'clear' button is normally in other places (like in the Places Manager in the searchbox itself). But the biggest problem is that they are part of the richlist scrolling list... Either add an header or footer to the list with number of (other) results, and clear button, just like in the places manager.
